Terms of Service

1. Agreement to Terms

By accessing and using the services provided by Mobiversal S.R.L. ("Mobiversal", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Services

Mobiversal provides software development, mobile app development, web development, UI/UX design, product strategy, and related consulting services. We also offer software applications through third-party marketplaces, including but not limited to the Atlassian Marketplace.

Estimation Tracker Application: We provide the "Estimation Tracker" application through the Atlassian Marketplace. It runs within your Atlassian/Jira environment and allows users to select projects from their Jira instance, apply various filters (such as issue type, assignee, and other project-specific criteria), and generate reports based on the filtered data. All data processing occurs within your Jira instance, and no data is stored on Mobiversal's servers or systems.

Team Alerts Application: We provide the "Team Alerts" application through the Atlassian Marketplace. It is a Jira Forge app that allows project administrators and authorized users to send notifications (email and/or in-app) to selected members of a Jira project. It runs on the Atlassian Forge platform and uses Jira Cloud APIs within your existing Jira site. We do not store your Jira data on our servers.

We reserve the right to modify, suspend, or discontinue any aspect of our services, including these applications, at any time without prior notice.

3. Use of Applications and Client Responsibilities

Estimation Tracker Usage: When using the Estimation Tracker application, you are responsible for ensuring that you have the necessary permissions to access the Jira projects and data you select. You agree to use it in compliance with Atlassian's terms of service and your organization's policies. You are solely responsible for the accuracy of the data you input and the reports you generate.

Team Alerts Usage: When using the Team Alerts application, you must use it in compliance with Atlassian's terms and your organization's policies. You are responsible for the content of notifications you send and for selecting appropriate recipients. You must not use the app to send spam, harass users, or violate any applicable laws.

General Client Responsibilities: Clients are responsible for providing accurate information, necessary materials, and timely feedback required for project completion. Delays in providing required information may affect project timelines and deliverables.

4. Intellectual Property

Marketplace Applications: The Estimation Tracker and Team Alerts applications, including all software, code, designs, documentation, and related materials, are the exclusive property of Mobiversal S.R.L. and are protected by copyright, trademark, and other intellectual property laws. Your use of these applications is subject to the license terms provided through the Atlassian Marketplace. You may not copy, modify, distribute, sell, or lease any part of them without our prior written consent.

Custom Development Services: Upon full payment for services, clients will receive ownership of the custom-developed work product, subject to any third-party licenses or open-source components used. Mobiversal retains the right to use project work for portfolio and marketing purposes unless otherwise agreed in writing.

5. Payment Terms

Marketplace Applications: Payment for the Estimation Tracker and Team Alerts applications is processed through the Atlassian Marketplace according to Atlassian's billing terms and your selected subscription plan. Refunds, if applicable, are subject to Atlassian Marketplace policies.

Custom Services: Payment terms for custom development services will be specified in individual service agreements. Clients are required to make payments according to the agreed schedule. Late payments may result in project delays or suspension of services.

6. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the course of the engagement. This obligation continues after the termination of services.

7. Limitation of Liability

Marketplace Applications: The Estimation Tracker and Team Alerts applications are provided "as is" without warranties of any kind. Mobiversal shall not be liable for any damages arising from the use or inability to use these applications, including but not limited to data loss, incorrect reports, or notification delivery issues. We are not responsible for the accuracy of data retrieved from your Jira instance or for decisions made based on reports or notifications generated by the applications.

General Services: To the maximum extent permitted by law, Mobiversal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability shall not exceed the amount paid by the client for the specific service in question.

8. Warranty and Support

Marketplace Applications Support: Support for the Estimation Tracker and Team Alerts applications is provided through the Atlassian Marketplace support channels. We will make reasonable efforts to address bugs and provide updates, but we do not guarantee uninterrupted or error-free operation. Support availability and response times may vary.

Custom Development Services: We provide a warranty period for our development work as specified in individual service agreements. Support and maintenance services are available under separate agreements. We do not guarantee uninterrupted or error-free service.

9. Termination

Marketplace Applications: You may cancel your subscription to the Estimation Tracker or Team Alerts applications at any time through the Atlassian Marketplace. We reserve the right to suspend or terminate access to either application for violations of these Terms or Atlassian's terms of service. Upon termination, you will lose access to the application and any stored data or configurations.

Custom Services: Either party may terminate custom development services with written notice. Upon termination, clients are responsible for payment of all work completed up to the termination date. Termination does not affect any obligations that have already accrued.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to active clients. Continued use of our services after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Romania.
